1. Who you're dealing with

Hevin Design is me, Michael Piras, based in South-West Sydney. I trade as a sole trader under ABN 58 368 892 845. When these terms say "I", they mean me. When they say "you", they mean the business I'm working for.

2. What I offer

I design and build websites, websites with the system behind them (things like online quoting, ordering, bookings, customer portals and dashboards), Shopify online stores, and ongoing care after launch. I don't currently offer branding, logo design or marketing.

3. Quotes and scope

Every project starts with a free call and a free written quote. The quote sets out what I'll build, the price and a launch date. The price is fixed: it doesn't change unless you ask to change the scope. If you do, I'll quote the change in writing, and I won't start it until you've agreed.

4. Payment

You pay 50% to start and 50% at launch. The start payment is due before work begins. The launch payment is due within 7 days of launch. If a payment is more than 14 days overdue, I may pause work until it's paid.

5. Timing

Most projects are live in 3–6 weeks, and every quote has a date on it. The date depends on me getting content, feedback and access from you when I need them. If those arrive late, the date moves by the same amount, and I'll tell you in writing.

6. What you own

You own the code, the domain, the accounts and the content. Your domain, hosting and other service accounts are set up in your name, and you pay those providers directly. Ownership of the code and design I create for you passes to you when the final payment is made. Third-party components (for example Shopify themes, apps or open-source libraries) stay under their own licences. I may show the finished work in my portfolio unless you ask me not to.

7. Fixes after launch

For 30 days after launch I fix, free of charge, anything that doesn't work as described in the quote. New features and changes to scope aren't fixes; I'll quote those separately.

8. Care

Care is optional and month to month. It covers updates, fixes and monitoring, and each month's work is itemised so you can see what you paid for. It doesn't include hosting; hosting stays in your own account. You pay each month in advance. You can cancel any time: care stops at the end of the month you've paid for, and you keep everything.

9. Leaving

There's no lock-in and no fee to leave. If you stop working with me, you keep your code, domain, accounts and content.

10. Cancelling a project

If you cancel before work begins, I'll refund your start payment in full. Once work has begun, the start payment isn't refundable, and you keep everything completed up to that point.

11. What I don't guarantee

I do the work carefully and to a professional standard. I can't guarantee specific results such as search rankings, traffic or sales.

12. Liability

My total liability for any claim is limited to the amount you paid me for the work the claim is about. I'm not liable for indirect or consequential losses. Nothing here limits any rights you have under Australian Consumer Law.

13. Confidentiality

I keep your business information confidential. I only share it where the work requires it (for example with the platforms your site runs on) or where the law requires it.

14. Disputes

If something goes wrong, we'll try to sort it out by talking first. These terms are governed by the laws of New South Wales, Australia.

15. Changes to these terms

I may update these terms. The version that applies to your project is the one in place when you accepted your quote.
